These Terms of Service (“Terms”) govern your access to and use of the ShepherdIQ website, mobile application, and related services (together, the “Service”). Please read them carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be able to form a binding contract to use the Service. If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

2. The registry and its content

ShepherdIQ provides a research database of German Shepherd Dogs, including pedigrees, show and working results, kennels, and associated people. Registry information is compiled from publicly available sources and community contributions. While we work to keep the data accurate and to reconcile and de-duplicate records, we do not warrant that any information is complete, current, or error-free. Registry content is provided for reference and research purposes only.

3. Acceptable use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Scrape, harvest, or bulk-download data except as expressly permitted by us in writing.
• Interfere with, disrupt, or place undue load on the Service or its infrastructure.
• Attempt to gain unauthorized access to any account, system, or data.
• Upload content that is unlawful, infringing, defamatory, or misleading.
• Misrepresent your identity or your affiliation with any person, kennel, or organization.

4. User contributions

The Service may let you submit corrections, kennel ownership claims, photos, and other content (“Contributions”). You represent that you have the rights necessary to submit your Contributions and that they do not infringe the rights of others. You grant ShepherdIQ a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and display your Contributions in connection with operating and improving the Service. We may review, moderate, edit, or remove Contributions at our discretion.

5. Intellectual property

The Service, including its software, design, and the compilation and presentation of registry data, is owned by ShepherdIQ or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, distribute, or create derivative works from the Service without our permission.

6. Third-party sources and links

The Service may reference or link to third-party websites and sources. We are not responsible for the content, accuracy, or practices of any third party, and inclusion of a link does not imply endorsement.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT REGISTRY DATA IS ACCURATE OR COMPLETE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHEPHERDIQ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify and hold harmless ShepherdIQ and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Service, your Contributions, or your violation of these Terms.

10. Suspension and termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

11. Changes to the Service and Terms

We may modify the Service or these Terms from time to time. When we change these Terms, we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which ShepherdIQ operates, without regard to conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless otherwise required by applicable law.
